Cafelam respects the intellectual property of others and follows the notice and takedown procedures of the United States Digital Millennium Copyright Act (DMCA). If you believe content on cafelam.com infringes your copyright, you can submit a DMCA notice using the process below.

Filing a notice

Send a written notice by email to hello@cafelam.com with the subject line “DMCA Notice”. Your notice must include all of the following to be actionable under the statute:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are at issue.
  3. Identification of the material on Cafelam that you claim is infringing, with enough specificity for us to locate it. The full URL of the article is the most helpful way to do this.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

Incomplete notices may be returned for correction. False or abusive notices can carry legal consequences under Section 512(f) of the DMCA.

What happens after

On receipt of a valid notice we will review it, remove or disable access to the specified material if the notice is actionable on its face, and notify the poster. We aim to act within a few business days of receipt.

Counter-notice

If your content was removed and you believe the removal was in error or the material is not infringing, you may submit a counter-notice. A counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the federal district court for your judicial district, or if outside the United States, the district in which Cafelam may be found, and that you will accept service of process from the person who filed the original notice.

On receipt of a valid counter-notice we will forward it to the original complainant. If the complainant does not file suit to restrain the alleged infringement within ten business days, we may restore the removed material.

Repeat infringers

Cafelam maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
